Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and 10676187 Canada Inc (“LemurIA,” “we,” “us,” or “our”) governing your use of the LemurIA mobile application and this website (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

LemurIA is a sound and frequency exploration tool. It generates tones and binaural beats and offers a personal frequency experience for relaxation, focus, and wellbeing. The Service is provided for personal, non-commercial use.

2. Wellbeing notice — not medical advice

LemurIA is a wellbeing and exploration tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition. It is not a substitute for professional medical, psychological, or therapeutic advice. Do not use the Service while driving or operating machinery. If you have a heart condition, a seizure disorder, wear a pacemaker, are pregnant, or have any medical concern, consult a qualified professional before use. Use headphones at a safe volume. Stop immediately if you feel unwell.

3. Eligibility & accounts

You must be at least the age of majority in your jurisdiction (or have a parent/guardian's consent) to use the Service. The free App does not require an account. For Premium, you are responsible for keeping your account credentials secure and for activity under your account. You agree to provide accurate information and to keep it current.

4. Subscriptions, billing & refunds

• Premium is offered as a subscription or one-time purchase, sold through the Apple App Store and Google Play.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel renewal in your App Store or Google Play account settings.
• Payment is charged to your store account at confirmation of purchase.
• Refunds are handled by Apple or Google under their respective policies; we generally cannot issue refunds directly.
• Prices and features may change; we will give notice where required, and changes will not affect a period you have already paid for.

5. Acceptable use

You agree not to:

• copy, modify, distribute, sell, sublicense, rent, or lease any part of the Service;
• reverse engineer, decompile, or attempt to extract the source code, frequency data, or underlying methods of the Service, except to the extent the law expressly permits;
• circumvent, disable, or interfere with security, licensing, or paywall features;
• use the Service unlawfully, or to build, train, or benchmark a competing product or dataset; or
• misrepresent your affiliation with us or remove any proprietary notices.

6. Intellectual property & ownership of the concept

The Service and everything in it — including the LemurIA name, logo, and branding; the ECHO system and its EXPAND / CONNECT / HEAL / OPEN pillars; the personal frequency / ECHO Scan concept; the curated frequency presets, groupings, descriptions, and copy; and the design, structure, and look and feel — is owned by us or our licensors and is protected by intellectual property and other laws. We reserve all rights not expressly granted.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use. This licence grants you no ownership and no right to reproduce, repackage, or create a product, app, or service that copies or is substantially similar to the LemurIA concept, branding, or presentation. Nothing here transfers any of our ideas, know-how, or intellectual property to you.

If you send us feedback or suggestions, you grant us a non-exclusive, perpetual, royalty-free licence to use them without obligation to you.

7. Working with us

We're open to partnerships, licensing, collaborations, and press. Rather than reproducing or building on our work independently, please reach out first — we'd genuinely like to hear from you. Contact [email protected] to discuss working together.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce any particular result or benefit.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could harm us or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

11. Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute, except where prohibited by local law.

12. Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new “Last updated” date, and your continued use of the Service after changes take effect constitutes acceptance.
